2. Scope of Application

These Terms and Conditions apply to all offers, orders and agreements concluded via the website www.gallerysuez.com. If the customer acts for professional purposes (B2B), Article 16 applies.

3. Products

Gallery Suez BV sells second-hand and vintage watches and accessories. Given the nature of second-hand goods: Signs of wear may be present Product descriptions and photographs form an integral part of the contract Minor deviations that do not affect functionality do not constitute a defect

4. Prices

All prices are displayed in EUR and include VAT unless stated otherwise. Shipping costs are clearly indicated before completing the order. For deliveries outside the European Union: Import duties, Customs charges
Local taxes, are entirely borne by the customer.

5. Order Process and Conclusion of Contract

Before placing an order, the customer is provided with: a summary of the selected products, the total price including shipping, a reference to these Terms and Conditions. The customer must explicitly accept these Terms and Conditions before completing the order. The contract is concluded once the customer receives an order confirmation email.

6. Right of Withdrawal (Consumers only)

Consumers have the right to withdraw from the contract within 14 days after receiving the goods, without giving any reason. To exercise the right of withdrawal, the customer must notify:

The customer must return the goods within 14 days after notification. Return shipping costs are borne by the customer. The product must: Be unworn beyond normal inspection, Be complete with all accessories, Be returned in its original packaging.

Gallery Suez BV may deduct compensation for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the goods.

7. Warranty – Second-Hand Goods

In accordance with Belgian law, second-hand goods are covered by a legal warranty period of one (1) year from delivery. The warranty covers hidden defects existing at the time of delivery.

The warranty does not cover: Normal wear and tear, Water damage, Damage caused by improper use, Accidental damage, Intervention by third parties. Unless explicitly stated, water resistance is not guaranteed.

8. Delivery and Risk

Delivery takes place at the address provided by the customer. Risk transfers to the consumer upon physical receipt of the goods. For international shipments outside the EU: The customer is responsible for customs formalities Delays caused by customs authorities are not attributable to Gallery Suez BV

9. Liability

Gallery Suez BV is not liable for: Indirect or consequential damages, Loss of profit , Third-party damages. Liability is limited to the purchase price of the product concerned. Nothing in these Terms excludes mandatory consumer rights.

10. International Orders

For shipments outside the EU:

All import duties and taxes are the responsibility of the customer
Refused deliveries due to unpaid customs duties remain the responsibility of the customer
Returns from outside the EU are made entirely at the customer’s risk and expense

11. Applicable Law and Jurisdiction

All agreements are governed by Belgian law.

Disputes fall under the exclusive jurisdiction of the courts of Antwerp, without prejudice to mandatory consumer protection rules.

12. B2B Transactions

For professional customers:

The right of withdrawal does not apply
The warranty regime may be contractually limited
Invoices are payable within 14 days unless otherwise agreed
